Terms of Service

By accessing or using the Vivance Studio platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Vivance Studio ("Vivance", "we", "us", "our"), a company incorporated in India.

Vivance Studio is a SaaS platform that allows users to create living memory experiences: QR-code-triggered video overlays linked to uploaded photos. We provide cloud hosting, QR generation, and playback infrastructure. You are licensing access to this platform — you are not purchasing software.

You must be at least 18 years of age to use the Service, or have the consent of a parent or legal guardian. By using the Service you represent that you meet this requirement.

You retain full ownership of all photos and videos you upload ("Content"). By uploading Content to Vivance, you grant us a limited, non-exclusive, royalty-free licence to store, process, and serve your Content solely for the purpose of operating the Service on your behalf. We will not use your Content for any other purpose, and we will not sell, licence, or distribute it to third parties.

You agree not to upload or use Content that:

• Infringes any third party's intellectual property, privacy, or other rights.
• Contains illegal, obscene, defamatory, or harmful material.
• Impersonates any person or entity.
• Is used to harass, threaten, or deceive others.
• Violates any applicable Indian law or regulation.

We reserve the right to remove Content and suspend or terminate accounts that violate these guidelines, without prior notice.

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance or updates from time to time, which may temporarily affect availability. We will endeavour to provide advance notice of planned downtime where possible.

Paid plans are billed in Indian Rupees (INR) via Razorpay. All prices are exclusive of applicable taxes unless stated otherwise. Subscriptions renew automatically unless cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods unless required by applicable law.

To the maximum extent permitted by law, Vivance Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

Either party may terminate this agreement at any time. You may stop using the Service and request deletion of your data. We may suspend or terminate your access for violations of these Terms. Upon termination, your Content will be deleted within 30 days unless we are required by law to retain it.

These Terms are governed by the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Faridabad, Haryana, India. We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
